1. Mommy Shorts may select one or more eligible submissions to use in the Mommy Shorts Monday Mornings series, sponsored by Allstate Insurance (“Allstate”), pursuant to the terms of these Terms & Conditions.

Eligibility

2. To be eligible an entrant must be 21 years of age or older and a legal resident of the 50 United States or Washington D.C. at the time of making a submission.

3. Employees, officers and directors of Mommy Shorts and Allstate, their respective parent companies, subsidiaries, affiliates, agents, partnerships, advertising and promotions agencies (individually and collectively, “Releasees”) or any members of the households or immediate families of such persons are not eligible.

4. Each person may only make one submission to the Monday Morning campaign (a “Submission”).

5. No person with a contract for talent representation (e.g., a talent agent, manager, etc.) is eligible.

Submission Requirements

6. Submissions can be made at www.mommyshorts.com (the “Website”) after 12:00 A.M. Eastern Time (“ET”) on 4/21/14 and ending with the announcement of the selected mothers on www.mommyshorts.com. 

7. The Submission must comply with the size, length and format requirements, as applicable, which are detailed on the entry page as well as these terms and conditions.

8. Your Submission, once posted in the comments will be viewable to the general public on the Website. Submissions will be viewable from that point forward.

9. The Submission must meet the following requirements:

• Submissions must be posted by a mother in the United States with kids living at home. Each submission must detail the city and state where the mother resides plus the number of kids and their ages.  

10. Your Submission may not contain, as determined by Mommy Shorts, in its sole discretion, any content that: 

• Contains third party materials that you have no rights to.
• Is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
• Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous;
• Is obscene or offensive; endorses any form of hate or hate group;
• Defames, misrepresents or contains disparaging remarks about Mommy Shorts, AllState, or their products and services or about other people, products or companies;
• Advertises or promotes any brand or product of any kind;
• Violates or encourages the violation of any law, rule or regulation;
• Promotes any particular political party, agenda or message; and/or
• Communicates messages or images inconsistent with the positive image and/or goodwill to which Mommy Shorts and AllState wish to associate

Mommy Shorts reserves the right to reject and/or not post any Submission that it deems, in its sole discretion, to be inappropriate for any reason whatsoever

11. Mommy Shorts will have the right to review, alter, modify, or otherwise edit the Submissions as it sees fit, and to use it in modified or distorted form without further consent from you or any third party appearing in the Submissions. Not all Submissions uploaded will be approved by Mommy Shorts, which may remove Submissions for any reason in its sole discretion. 

12. Incomplete Submissions, or Submissions that do not meet the requirements herein, may not be considered.

Photo Shoot for Submissions Selected by MommyShorts and Allstate

13. Participants whose Submissions are selected will receive an opportunity to participate in a photo shoot with photographer Raquel Bianca, at their own home on a weekday morning to document their typical morning routine.

14. 12 mothers will be chosen from four cities— three in each. Selection will be based heavily on location and coordination of schedules (e.g., coordinating participants’ schedules with photographer’s availability). Further questions may be asked of those Submissions under consideration.

Your Representations Regarding Your Submission

15. By entering a Submission, you warrant and represent the following with respect to your Submission: (a) you are the sole and exclusive owner of the Submission; (b) your Submission is your own creation and is 100% original and (c) your Submission will not infringe on any rights of any third parties, including, but not limited to, any third party copyrights, trademarks, or any person’s rights of publicity or rights of privacy.

16. By entering a Submission you grant Mommy Shorts an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to use, display, publicly perform, modify, reproduce, publish, distribute, make derivative works of, sublicense or otherwise commercially and non-commercially exploit the Submission in any media now known or hereafter developed. Submissions may be cut, edited, reformatted, rearranged, combined with other materials and/or otherwise modified, in Mommy Shorts’s sole and absolute discretion. You understand that your Submission may, but is not required to be, displayed for public viewing and voting, if applicable, as part of this event.

17. By entering a Submission, you agree to the use of your name, likenesses, biographical information, Submissions and/or statements for purposes of advertising, trade, or promotion without further compensation, unless prohibited by law.

If Submission is Selected by Mommy Shorts

18. If Mommy Shorts elects to use a Submission, you will be notified by email at the email address listed in your Submission. 

19. If your Submission is selected, you will also be required to execute an Affidavit of Eligibility, a Liability Release and where lawful, Publicity Release or other documentation as determined by Mommy Shorts within 10 days of notification. If you fail to respond to the notification or fail to return all required documentation within 10 days, and/or if attempted notification is returned as undeliverable, you and your Submission may be disqualified and an alternate Submission may be selected provided sufficient time remains, in Mommy Shorts’s discretion.

20. If MommyShorts shall desire to secure additional assignments, releases, certificates of engagement for the Submission or other documents as Mommy Shorts may reasonably require in order to effectuate the purposes and intents of the agreements hereunder, then You agree to sign the same upon Mommy Shorts’ request therefore (without any need for any additional consideration).

21. You may also be required to submit to a confidential background check (to help ensure that your participation in Mommy Shorts or Allstate promotional materials (including without limitation, the Monday Morning series) will not, in Mommy Shorts’s sole discretion, bring Mommy Shorts and/or Allstate into public disrepute, contempt, scandal and/or ridicule.

No Compensation

22. You understand that you will not receive compensation for participation hereunder, even if your Submission is selected by MommyShorts.

Release

23. By participating you agree to indemnify, release and hold harmless Releasees from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever arising out of or resulting from the use of the Submissions, including without limitation any names, usernames, and/or likenesses of you or any other individual in the Submissions or the rights of anyone who participated in the taking of any photograph/video included therein, or from any third party elements in the Submissions in accordance with the terms hereof or your breach of any warranties or representations in this agreement, or including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in this promotion or participation in any promotion-related activity and claims based on publicity rights, defamation or invasion of privacy. Neither Mommy Shorts nor Allstate (including each of their respective parents, affiliates, subsidiaries, agencies, divisions and related companies) are responsible for any damages, taxes, or expenses that entrants might incur as a result of this promotion or use, misuse or non-use of your Submission. 

Nature of Relationship

24. You acknowledge and agree that the relationship between you and the Releasees is not a confidential, fiduciary, or other special relationship. 

25. You understand that the Releasees have wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees.  You also acknowledge that many ideas or stories may be competitive with, similar or identical to the Submission and/or each other in theme, idea, plot, format or other respects. You acknowledge and agree that you will not be entitled to any compensation as a result of Releasees’ use of any such similar or identical material that has or may come to Releasees, or any of them, from other sources.

26. You acknowledge and agree that the Releasees do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the Releasees’ copyright in and to the Submission.

Use of Data 

27. All Submissions or other materials and personal information submitted may be shared by and between the Releasees, and each of the Releasees will use such information in accordance with their respective independent privacy policies. Any communication or information transmitted to Allstate, MommyShorts and/or the Website by electronic mail or otherwise is and will be treated as non-confidential. Please review each of Mommy Shorts’ and Allstate’s respective privacy policies at [https://www.mommyshorts.com/disclaimer.html]. By participating, applicants hereby agree to Mommy Shorts’ and Allstate’s collection and usage of their personal information and acknowledge that they have read and accepted each of their respective privacy policies.

Right to Terminate

28. Mommy Shorts reserves the right to change the terms of this promotion at any time. Mommy Shorts also reserves the right to not select any Submission, and/or to cancel the promotion and/or not produce any publicity or entertainment materials in connection with the promotion. 

In the event of any situation not provided for in these terms or any conflict between any provisions of these terms, the decision of Mommy Shorts shall be final and binding. 

The promotion sponsor is Allstate Insurance
